This consent becomes effective, valid, and legally binding immediately upon clicking the designated electronic consent checkbox, or upon completing any booking or payment process via the Platform.<\/p>\r\n
\u200bLegal Age Limit: The Participant must be at least eighteen (18) years of age to utilize the Platform’s services independently. Participation of minors (under the age of 18) is strictly prohibited unless an express, signed written consent is provided by a parent or legal guardian.<\/p>\r\n
\u200bArticle 2: Legal Status of the Platform (Disclaimer Regarding Hosts)<\/strong><\/p>\r\n\u200bIndependent Contracting: The Participant acknowledges and understands that all hosts, guides, and organizers listed on the Platform are independent contractors, and are not employees, agents, or official representatives of the Platform.<\/p>\r\n
\u200bLimitation of Platform Liability: The Platform\u2019s liability is strictly limited to providing the digital marketplace that connects participants with hosts. Consequently, the independent host bears full legal, operational, and civil liability for the organization, management, and quality of the activities and trips they provide, without any joint, several, or vicarious liability on the part of the Platform.<\/p>\r\n
\u200bArticle 3: Personal Liability and Assumption of Risk<\/strong><\/p>\r\n\u200bInherent Risks: The Participant acknowledges their full awareness and understanding that outdoor and sporting activities (such as hiking, cycling, and running) inherently involve physical and environmental risks and challenges. The Participant assumes sole and absolute personal responsibility for their own safety and preparedness during the activity.<\/p>\r\n
\u200bPhysical Fitness and Medical Disclosure: The Participant undertakes to ensure they possess the necessary physical fitness and health conditions to undertake the chosen activity, and must disclose to the organizers any health conditions or medical restrictions that may affect their safety.<\/p>\r\n
\u200bPersonal Insurance: The Platform strongly advises all participants to obtain a comprehensive personal insurance policy covering sports activities, outdoor adventures, and personal injuries prior to joining any trip.<\/p>\r\n
\u200bArticle 4: Emergency Medical Care<\/strong><\/p>\r\n\u200bBy virtue of this agreement, the Participant grants explicit authorization to the host or organizer to take all urgent medical measures, arrangements, and first-aid procedures deemed necessary to preserve their life and safety in the event of an emergency during the activity. The Participant acknowledges that they shall bear sole and full liability for all financial costs and expenses resulting from such emergency treatment.<\/p>\r\n
\u200bArticle 5: Punctuality and Event Attendance Regulations<\/strong><\/p>\r\n\u200bMeeting Point: The Participant bears absolute responsibility for arriving at the designated meeting point at the exact scheduled time without delay.<\/p>\r\n
\u200bParticipant Delay: In the event that the Participant arrives late, the host or organizer reserves the right to deny them entry or participation in the activity, in order to preserve the trip schedule and respect the commitment to the rest of the group. In such case, the Participant forfeits all rights to claim any compensation or financial refund for the amounts paid.<\/p>\r\n
\u200bArticle 6: Financial Provisions, Cancellation, and Refund Policy<\/strong><\/p>\r\n\u200bBooking Confirmation: Bookings are not considered confirmed until the financial value has been paid in full in advance through the approved electronic payment gateways on the Platform.<\/p>\r\n
\u200bCancellation by the Customer (Flexible Policy): All cancellation requests submitted by participants are subject to the following timeframes and deduction rates:<\/p>\r\n
\u200bCancellation more than forty-eight (48) hours prior to the scheduled event: The Participant is entitled to cancel the booking and receive a full refund of the amount paid (less a 5% administrative and bank processing fee).<\/p>\r\n
\u200bCancellation between twenty-four (24) and forty-eight (48) hours prior to the scheduled event: A deduction of 50% of the total booking value will be applied as a late cancellation fee to cover preparation and seat reservation costs, and only the remaining half will be refunded to the Participant.<\/p>\r\n
\u200bCancellation less than twenty-four (24) hours prior, or Non-Attendance (No-Show): The Participant completely forfeits their right to claim any refund, and a deduction of 100% of the total booking value will be applied.<\/p>\r\n
\u200bTime Limit for Complaints: In the event of any grievance or complaint relating to the activity, it must be officially submitted to the Platform within a period not exceeding fourteen (14) days from the conclusion date of the event. The right to review any claim shall lapse after the expiration of this deadline.<\/p>\r\n
\u200bForce Majeure and Emergency Circumstances: The Platform and the hosts shall be exempted from any liability for delays or cancellations resulting from Force Majeure events beyond reasonable control. This includes, but is not limited to: severe weather conditions, emergency government decrees or warnings, labour strikes, or public transport closures. In the event that a trip is entirely cancelled by the Platform or the host due to Force Majeure, a full refund will be issued to the participants.<\/p>\r\n
\u200bArticle 7: Governing Law and Jurisdiction<\/strong><\/p>\r\n\u200bThese Terms and Conditions shall be governed by, and construed in all respects in accordance with, the Laws of England and Wales.
